NRCC TARIFF NO. 5: USE OF MUSIC TO ACCOMPANY LIVE EVENTS

Festivals & Events Ontario recently became aware that the Neighbouring Rights Collective of Canada (NRCC) had filed with the Copyright Board of Canada a new tariff (No. 5 - Use of Music to Accompany Live Events) that would significantly negatively impact festivals and events in Ontario.

Specifically, Tariff No. 5, if approved by the Copyright Board of Canada, would implement a levy of 5% of gross receipts (ie: the total amount received for admission to an event and would include ticket sales, admission fees, and cover charges), payable monthly, on any festival and/or event organization that plays recorded background music at a live event. If approved by the Copyright Board of Canada, this levy would be made retroactive to January 1, 2008.

Festivals & Events Ontario has drafted a template letter and background information document that you may wish to send to your local federal MP to represent your interests and how this proposed tariff will affect your on this major potential national issue. Both documents can be modified to better suit your local, individual needs as required.

WIND POWER & WINDMILL DEVELOPMENT

SkyPower Corp. is proposing the development of 4 individual 9MW Wind Power Projects in Renfrew and South Algonquin Counties in response to the Ontario Power Authority's (OPA) Renewable Energy Standard Offer Program (RESOP).

The locations of the proposed Wind Power Projects are as follows:

Wilno - 6 turbines (1.5 MW capacity each) 9 MW total capacity. Project connected to the local distribution grid. North of Hwy 60 on privately-owned land.

Foymount - 6 turbines (1.5 MW capacity each) 9 MW total capacity. Project connected to the local distribution grid. Located on Raddatz Road, just South-East of Foymount, on privately-owned land.

Killaloe - 6 turbines (1.5 MW capacity each) 9 MW total capacity. Project connected to the local distribution grid. Located on the south side of Rochefort Road, 8km south-west of Killaloe, on privately-owned land.

Madawaska - 6 turbines (1.5 MW capacity each) 9 MW total capacity. Project connected to the local distribution grid. Located 8km south-west of the Township of Madawaska on privately-owned land.

Wind projects require rigorous approvals. These include community consultation and several municipal and environmental processes. As an example, under the environmental assessment process, each individual turbine location must meet provincial and federal requirements in relation to its auditory and visual impacts on all nearby residents.

Environmental Screening Reports (ESR) are in process. These ESRs include findings from the assessments and recommendations on how to mitigate potential adverse effects. Upon completion, the ESRs are submitted to government agencies and the public for review. All interested parties are given 30 days to review the ESRs and make comments. ESRs will be posted on the Canadian Environmental Assessment Registry (CEAR) and will be made available locally to the public.

Numerous public meetings and advertising campaigns have been held throughout the region in an effort to provide more information about the proposed projects, including potential negative/positive impacts, including impacts to the tourism industry.
